General Terms and Conditions for the Use of GetSnapp Services

These General Terms and Conditions ("Terms") apply to the use of the software-based services provided by GetSnapp LLC, a company duly organized and existing under the laws and regulations of the Dubai, United Arab Emirates, with its registered address in Dubai (hereinafter referred to as "GetSnapp", "we", "us", or "our").

By accessing or using our website, services, or any applications related to GetSnapp (collectively, the "Platform"), you ("User", "you", or "your") agree to be bound by these Terms. If you do not accept these Terms, you must refrain from using our Platform.

1. Subject Matter of the Agreement

1.1 GetSnapp provides an online tool that enables Users to upload images, optionally input names or other text, remove backgrounds from images, and automatically integrate the results into predefined flyer templates which can be downloaded.

1.2 The service does not require user registration. The entire process is executed on an anonymous and session-based basis. Generated content is stored temporarily and automatically deleted.

1.3 GetSnapp retains the right to expand or modify the services offered on the Platform at its sole discretion. This includes the future introduction of paid service plans for individual consumers and enterprise solutions for business clients. All pricing models, features, and access tiers shall be defined exclusively by GetSnapp and may be adjusted or restructured at any time without prior notice.

2. User Rights and Obligations

2.1 Users are granted a non-exclusive, non-transferable, and revocable license to use the services provided via the Platform for personal and commercial purposes, subject to these Terms. In addition, Users have the right to submit assets, designs, layouts, or presentation materials that may contribute to the improvement or expansion of available flyer templates and design offerings. GetSnapp encourages such contributions to enhance usability for the wider direct sales and network marketing community. While submission does not guarantee adoption, all suggestions will be reviewed on a discretionary basis.

Users may also request the addition of flyer templates specific to direct sales or network marketing companies not yet featured in the Platform. GetSnapp will consider such requests based on technical feasibility, brand consistency, and demand. Submission of requests or assets does not confer any ownership or control rights over the Platform or resulting materials.

2.2 The User must refrain from uploading any unlawful, obscene, discriminatory, or otherwise inappropriate content. In particular, content related to hate speech, nudity, impersonation, or illegal conduct is strictly prohibited. The User acknowledges and agrees that they bear full and exclusive legal responsibility for any violation of this provision. In the event of a breach, the User shall indemnify and hold harmless GetSnapp LLC from any resulting claims, liabilities, damages, penalties, or legal actions, whether civil or criminal, arising from such misuse or infringement.

Furthermore, where the User submits any assets, materials, designs, presentations, or related content for the purpose of improving the quality of flyer templates or features within the Platform, the User represents and warrants that they have the full legal right, authority, and license to share such content with GetSnapp. The User accepts full legal responsibility for the accuracy, authenticity, and non-infringement of the submitted materials. GetSnapp assumes no liability for the origin, ownership, or use of user-submitted content and reserves the right to reject or remove any such content at its sole discretion.

2.3 Users agree not to interfere with or disrupt the operation of the Platform or the servers and networks connected to it.

3. Intellectual Property Rights

3.1 GetSnapp retains all intellectual property rights in the software, algorithms, templates, designs, and all content made available on the Platform, except for User-uploaded content and the generated output specific to each session.

3.2 Users retain full ownership of the images they upload and the generated output. GetSnapp does not store, claim, license, or use this content for any purpose beyond enabling the session-based download. All user data processed by the Platform is anonymized and is not linked to any identifiable individual. No user data is used outside the scope explicitly defined within these Terms. GetSnapp strictly adheres to data minimization and privacy-by-design principles to ensure user confidentiality and data protection at all times.

3.3 No data is permanently stored. Files are held only temporarily in the system's active memory and deleted upon session expiry.

3.4 Where the User voluntarily submits any templates, designs, assets, or other creative materials ("User Contributions") for potential inclusion in the Platform, the User hereby grants GetSnapp LLC a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable, and transferable license to use, reproduce, adapt, publicly display, modify, distribute, and otherwise exploit such User Contributions for any purpose related to the development, enhancement, or promotion of the Platform or its associated services. The User acknowledges and agrees that:

(a) Submission of User Contributions does not entitle the User to any form of compensation, attribution, or proprietary rights over the Platform;
(b) The User warrants that they have all necessary rights, licenses, and authorizations to grant the above license and that the content does not infringe any third-party rights;
(c) To the extent permitted by law, the User waives all moral rights (including the right to be identified as the author) in respect of the User Contributions;
(d) GetSnapp LLC reserves the right, but is not obligated, to use, publish, or modify any such contributions.

4. Use of Generated Content

4.1 Users may freely use, distribute, and publish the flyers generated using the Platform. There are no usage restrictions for the generated materials. Users may also directly share the generated images with others using built-in sharing or referral features made available on the Platform. These features are provided to facilitate wider distribution and usage of generated content without requiring additional registration or identification.

If a User creates flyers featuring individuals other than themselves, the User is solely responsible for ensuring that they have obtained the necessary consent to use those individuals' photos or likenesses. Users must only use images that they either own, have been given explicit permission to use, or are publicly available and legally permissible for use in such a context. GetSnapp LLC does not verify or validate the origin or authorization of images used by Users and disclaims all liability for any unauthorized or unlawful use of third-party images.

4.2 Users are solely responsible for any claims or disputes arising from the use of generated content. GetSnapp LLC disclaims all responsibility and liability for how users utilize the services or the output generated through the Platform. The User acknowledges that any use, sharing, modification, or publication of the generated content is done entirely at their own risk and legal responsibility. GetSnapp does not monitor, control, or verify the purpose or legality of user actions and shall not be held liable for any consequences, direct or indirect, resulting from such actions.

5. Temporary Data Processing

5.1 GetSnapp does not collect or retain personal data.

5.2 Uploaded images and generated content are stored only temporarily on secure AWS (Amazon Web Services) infrastructure to facilitate download functionality. AWS provides a highly secure environment, employing physical security measures, continuous monitoring, and industry-standard encryption protocols (such as AES-256 for data at rest and TLS for data in transit). Access to data is tightly controlled using AWS Identity and Access Management (IAM), ensuring that only authorized processes handle the temporary data. AWS is compliant with numerous international security certifications including ISO 27001, SOC 1/2/3, and GDPR alignment, making it a globally trusted platform for data protection and privacy assurance. GetSnapp leverages these protections to ensure that all temporary files are handled with strict confidentiality and promptly deleted according to the principles outlined in this document.

5.3 After a short time (typically a few minutes), all data is automatically and permanently deleted from the system. This is done to uphold the principle of privacy-by-design and to prevent any potential misuse, unauthorized access, or retention of user data. The deletion process is automated through server-side scripts and AWS lifecycle management rules that identify and remove session-specific files once their intended use expires. Files are stored in encrypted storage (using AES-256) and are inaccessible after deletion due to the loss of reference pointers and encryption keys. This ensures that even in the unlikely event of physical or system-level access, the data remains irretrievable and unintelligible. By implementing this mechanism, GetSnapp guarantees that user data is processed only to the minimal extent necessary for functionality and is securely destroyed in compliance with international privacy standards.

6. Availability and Service Level

6.1 The Platform is provided on an "as is" and "as available" basis without any guarantees, representations, or warranties of any kind, either express or implied. GetSnapp makes no assurance that the Platform will be uninterrupted, timely, secure, or error-free. Service interruptions may occur due to maintenance, upgrades, internet failures, third-party service outages, or events beyond GetSnapp's control (including force majeure situations).

6.2 GetSnapp reserves the right to temporarily suspend or restrict access to the Platform without notice for the purposes of system maintenance, performance enhancements, content updates, or security improvements. Where feasible, advance notice will be provided, but such notice is not guaranteed. Users acknowledge and accept the risk of temporary unavailability and shall not hold GetSnapp liable for any resulting disruptions or losses.

6.3 Users are responsible for ensuring that their own device, internet connection, browser compatibility, and any additional technical requirements are adequate to access and utilize the Platform. GetSnapp is not liable for failure to access or use the Platform due to user-side limitations.

7. Liability

7.1 To the maximum extent permitted by applicable law, GetSnapp excludes any liability for direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, goodwill, data, or other intangible losses arising from:

The use or inability to use the Platform;
Unauthorized access to or alteration of User content;
Any conduct or content of any third party using the Platform;
Inaccessibility or downtime of the Platform;
Data loss or corruption due to technical failure;
Misuse of the Platform by Users;
Use of generated content in violation of third-party rights;
Any other matter relating to the Platform.

7.2 GetSnapp does not assume responsibility for the legality, appropriateness, or authenticity of any images, names, or materials uploaded by Users. Users are fully responsible for ensuring that their content complies with all applicable laws and third-party rights.

7.3 The Platform may contain links to external websites or services. GetSnapp does not control or endorse any external content and disclaims liability for any reliance placed on third-party resources accessed through the Platform.

7.4 The User agrees to indemnify, defend, and hold harmless GetSnapp LLC, its affiliates, officers, directors, employees, licensors, partners, and agents from and against any and all claims, liabilities, losses, damages, expenses, and costs (including reasonable attorneys' fees and court costs) arising out of or relating to:

(a) the User's use or misuse of the Platform or generated content;
(b) any violation of these Terms;
(c) infringement of any intellectual property rights, publicity rights, or privacy rights of a third party;
(d) the unauthorized use of images, likenesses, or personal data of any individual;
(e) any breach of representations and warranties made under these Terms;
(f) any disputes or legal actions arising from User Contributions or shared templates.

This indemnification obligation shall survive termination or expiration of these Terms.

8. Fees and Pricing

8.1 The Platform is currently offered free of charge. Any future updates to pricing, including the introduction of premium features or enterprise subscriptions, will be published and made accessible online under the section titled "Pricing" on the Platform. Users are encouraged to review that section periodically to stay informed about applicable fees.

8.2 GetSnapp reserves the right to introduce premium features or subscriptions. In such case, new pricing structures and related terms will be published and communicated in advance.

9. Governing Law and Dispute Resolution

9.1 These Terms are governed by and construed in accordance with the laws and regulations of the Dubai Internet City Free Zone.

9.2 Any disputes arising out of or in connection with these Terms shall first be submitted to mediation or arbitration, as a primary means of dispute resolution. If mediation fails or is refused by either party, the dispute shall be resolved by arbitration under the Rules of Arbitration of the International Chamber of Commerce (ICC), with the seat of arbitration in Dubai, UAE, and the language of proceedings being English.

10. Email Marketing and Publicity

10.1 If the User has signed up to receive marketing messages, the User may opt out at any time by clicking the "unsubscribe" link included in such communications, or by contacting GetSnapp via email at info@getsnapp.ai. However, Users may not opt out of service-related communications, including but not limited to technical updates, billing confirmations, service-related announcements, or legal notifications.

10.2 The User permits GetSnapp to use the User's name, logo, or publicly available branding to identify them as a customer on GetSnapp's website and in marketing or promotional materials, in accordance with any trademark guidelines or usage instructions provided by the User. The User also permits GetSnapp to issue a press release announcing the User as a client, subject to prior written approval of the content of such release. Following approval, GetSnapp may reuse the press release contents in its website content and future marketing materials.

11. Amendments

11.1 GetSnapp reserves the right to amend or update these Terms at any time.

11.2 Users will be informed of significant changes via the Platform. Continued use after changes implies acceptance.

12. User Feedback and Improvement Suggestions

GetSnapp welcomes feedback, suggestions, bug reports, and feature requests submitted by Users for the improvement of the Platform ("Feedback"). By submitting such Feedback, the User agrees that:

(a) Feedback is provided voluntarily and without expectation of compensation or attribution;
(b) GetSnapp shall have a perpetual, irrevocable, worldwide, royalty-free, sublicensable right to use and incorporate such Feedback into its products or services, without any obligation to the User;
(c) Feedback shall not be deemed to create any fiduciary or confidential relationship;
(d) Users shall not submit any proprietary, confidential, or trade-secret information as Feedback.
